Terms of Service

1 Service Definition

Cube Connect is a cloud-based software platform (Software as a Service) that provides tools for managing digital communication between businesses and their customers, including but not limited to:

• Sending messages
• Managing conversations
• Marketing campaigns
• Automated replies
• Automation flows
• Contact management
• API integration

The platform is provided as a technical tool for managing communication and does not control the content sent by users.

2 Eligibility

By using the platform, you acknowledge that you:

• Are at least 18 years old
• Have the legal authority to use the service
• Use the platform for lawful purposes only

If you are using the service on behalf of a company or business entity, you confirm that you have the legal authority to represent that entity.

3 Account Creation

Using certain platform features requires creating a user account. The user bears full responsibility for:

• The accuracy of information provided during registration
• Protecting login credentials
• All activities conducted through the account

The user must notify Cube Connect immediately if they suspect any unauthorized use of their account.

4 Platform Usage

The user agrees to use the platform in a lawful and responsible manner. The following uses of the platform are prohibited:

• Sending unsolicited or spam messages
• Fraud or identity impersonation
• Publishing illegal content
• Violating the rights of others
• Collecting or using data illegally
• Impersonating WhatsApp, Meta, or any official, security, banking, or government entity, or leading recipients to believe messages originate from them
• Phishing or requesting sensitive data — such as verification codes (OTP), security codes, passwords, PINs, or card details — or any scheme aimed at taking over other people's accounts

The user is fully responsible for all messages and content sent through the platform. Any violation of the above — particularly impersonation, phishing, or requesting verification codes — is a severe breach that warrants immediate suspension of the account without prior notice and without refund, and we reserve the right to report it to the relevant authorities.

5 Recipient Consent

The user acknowledges that they have obtained explicit prior consent from recipients before sending any marketing or promotional messages.

The user bears full responsibility for any violation related to sending unsolicited messages.

6 Data Management

The user may enter their customer data within the platform. The user acknowledges that they:

• Have the legal right to use that data
• Have obtained consent from the data owners
• Comply with applicable privacy laws in the countries where they operate

Cube Connect bears no legal responsibility for data entered by the user.

7 Automation and Auto-Replies

The platform provides tools for automation, conversation flows, and auto-replies. The user is fully responsible for:

• Configuring these systems
• Messages generated by them
• Consequences resulting from their use

8 API Interface

The platform provides an API interface that allows integration with other systems. The user is responsible for:

• Protecting their API keys
• All operations performed using those keys
• Complying with specified usage limits

The platform reserves the right to revoke or suspend any API key in case of misuse.

9 Subscriptions and Fees

The platform operates on a subscription basis. By subscribing to any plan, the user agrees to:

• Pay the specified fees for the chosen plan
• Automatic subscription renewal unless cancelled
• Possible account suspension in case of non-payment

Your subscription starts on the date payment is received through the platform's authorized payment gateway. You may cancel your subscription at any time and will continue to have access to the service until the end of your paid subscription period.

To the extent permitted by applicable law, payments are non-refundable, and we do not provide refunds or credits for any partial subscription periods. When you cancel a subscription or change your plan (upgrade or downgrade), the value of the remaining period is calculated and transferred to your account's electronic wallet for use within the platform — to renew subscriptions, upgrade plans, or purchase paid add-ons and features. The wallet balance is tied to your account and cannot be withdrawn outside the platform or transferred to another account, and amounts added to the account as promotional rewards or free credit are non-refundable.

Users may add WhatsApp numbers or sessions beyond what their current plan includes against additional fees per the price list published inside the platform. The validity of additional numbers is tied to the same subscription period of the main plan and ends with it. Each additional number is charged independently from the plan price, and its fee is prorated at the time of addition based on the remaining days of the current billing cycle. When an additional number is deleted before the end of its billing cycle, the value of the unused days is calculated and automatically credited to the account's electronic wallet under the wallet policy described above. Additional sessions, on the other hand, are sold as bundles — each bundle has its own validity period that varies with the bundle size, starting from the date of purchase, independent of the subscription renewal date; session bundles are non-refundable after purchase as they are consumable.

Cube Connect may change subscription plans, fee prices, or the services we offer from time to time; however, we will notify you of any change to pricing, subscription plans, or services at least thirty (30) days before it takes effect.

Monthly subscription periods are calculated on a calendar-month basis, renewing on the same day of each month as the subscription start date. If that day does not exist in the following month (e.g. a subscription started on the 31st while the following month has 30 days or fewer), renewal occurs on the last day of that month. Annual subscriptions are calculated as twelve (12) calendar months from the start date. These natural variations in month length do not constitute a breach of the subscription and do not give rise to any right of refund or compensation.

10 Intellectual Property

All intellectual property rights related to the platform are reserved, including: software, code, design, trademarks, and content.

The user may not:

• Copy the platform
• Resell or redistribute it
• Modify or attempt to reverse-engineer it

11 Account Suspension or Termination

Cube Connect reserves the right to suspend or terminate the account at any time in the following cases:

• Violation of the terms of service
• Misuse of the platform
• Using the service for illegal activities
• Causing harm to the platform or other users

The account may be suspended without prior notice in severe cases.

12 Disclaimer

The service is provided "as is" without any express or implied warranties. Cube Connect makes no guarantees regarding:

• Achieving specific business results
• Increasing sales
• Success of marketing campaigns
• Accuracy of results or analytics

Use of the platform is entirely at the user's own risk.

13 Limitation of Liability

To the maximum extent permitted by law, Cube Connect shall not be liable for any direct, indirect, or consequential losses, including:

• Loss of profits
• Loss of data
• Loss of customers
• Business interruption

Arising from the use of the platform or inability to use it. In all cases, the maximum liability of the platform shall not exceed the amount paid by the user for the service during the last 12 months.

14 Indemnification

The user agrees to indemnify and hold Cube Connect harmless from any claims, losses, damages, or legal costs arising from:

• Their use of the platform
• Messages or content they send
• Violation of these terms
• Violation of any third-party rights

15 Modifications

Cube Connect reserves the right to modify the terms of service at any time. Continued use of the platform after the update is published constitutes acceptance of the modified terms.
